Introduction
By logging to, connecting to, accessing or using our Site, you acknowledge that you have read and understood the following Terms of Use including the terms of our Privacy Policy collectively, the “Terms” and you agree to be bound by them and to comply with all applicable laws and regulations regarding your use of the Site and you acknowledge that these Terms constitute a binding and enforceable legal contract between Sankara Cuisine Ltd and you. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ENTER TO, CONNECT TO, ACCESS OR USE THE SITE IN ANY MANNER. You expressly agree that your use of the Sankara platform and all inherent services and goods are provided “As IS” and “As Available” for your use and “For Use and Consumption” AT YOUR OWN RISK.
Definition of Users
The Sankara Marketplace facilitates the ordering by consumers/end users of the Marketplace ("Customers") of products such as food, craft and others offered by restaurants, artisans and store owners through the platform ("Vendors") and the delivery of such products through independently contracted couriers. Collectively, Customers and Vendors constitute "Users" of the Sankara Marketplace and these Terms of Service apply to all Users.
Accurate Information
You represent and warrant that all information supplied by you on the Sankara Marketplace (including information provided by you to create an account for use of the Marketplace or in connection with your use of the Marketplace is true, accurate, current and complete.
Goods from Vendors
The legal contract for the purchase of Goods will in all cases be between the Customer and the Vendor. You irrevocably appoint and authorize us to act as your sole and exclusive agent for the purpose of concluding contracts for the sale of Goods between you and the Vendor by means of you placing Orders via the Sankara Marketplace. We may act as agent for the Customer and the Vendor for the legal contract for the purchase and sale of the Goods. YOU ACKNOWLEDGE AND AGREE THAT NO MEMBER OF THE SANKARA MARKETPLACE ADMINISTRATION HAS ANY CONTROL OVER THE QUALITY OF THE GOODS OR SERVICES OFFERED BY VENDORS AND COURIERS AND THAT NO MEMBERS OF THE SANKARA MARKETPLACE ADMINISTRATION WILL HAVE LIABILITY TO YOU FOR ANY PROBLEMS CAUSED BY THE VENDOR/CHEF/ARTISAN CONCERNING YOUR ORDERS, INCLUDING, WITHOUT LIMITATION, MISSED OR LATE DELIVERIES, MISSED GOODS ITEMS, AND ANY PROBLEMS WITH RESPECT TO THE QUALITY OF THE GOODS DELIVERED INCLUDING IF GOODS CAUSE ILLNESS, ALLERGIC REACTIONS OR HAVE INCORRECT NUTRITIONAL VALUES.
Intellectual Property
You agree that the information found within the Sankara Cuisine Ltd platform and Marketplace, including but not limited to Catering, Crafts, Ordering, Events, will never be used for any unauthorized promotions, will not be duplicated or reproduced in any way whatsoever. You, The “User/the Buyer”, may not use the information therein to produce any derivative products from the goods or services provided within our platform, you may not resell the products, goods or services, or redistribute them with malicious intent.
Access to The Ordering platform and agreeing to the Terms means that you have acknowledged and fully adhered to our Terms as they are therein stated in full. The Site is available only to individuals who (a) are at least eighteen (18) years old (see Section on Minors below); (b) possess the legal authority (on behalf of themselves and their organization) to enter into these Terms and to form a binding agreement under any applicable law.
How do we collect information on our Users/Buyers?
We collect information through your use of the Site. In other words, when you are using the Site we are aware of it and may gather, collect and store the information relating to such usage, either independently or through the help of third-party service providers as will be detailed below.

For example, we collect Personal information which you voluntarily provide when you fill in the contact form and/or during the Ordering Process within the Site. We may gather, collect and store the Personal Information either independently or through the help of our authorized third-party service providers as will be detailed below.

We do this in order to provide advertisements about goods and services likely to be of greater interest to you.
Payment
We accept certain online payment methods, using our Online Payment Processors, which enable Users to send and receive payments securely online using a credit card or bank account. We may add or change the Online Payment Processors at our sole discretion. Sankara Cuisine Ltd is not affiliated with such Online Payment Processors, as each is an independent contractor, and neither is the agent or employee of the other, and neither is responsible in any way for the actions or performance (or lack thereof) of the other. The use of the Online Payment Processors is at the User's/Buyer’s discretion and sole liability and risk. It is the User's responsibility to abide by all the terms specified by the Online Payment Processors in their terms of use and privacy policies, including but not limited to any age restrictions specified therein. You acknowledge that you are fully assuming the risks of conducting any transactions via the Online Payment Processors when you use our platform to perform an order.
Security
We take reasonable measures to maintain the security and integrity of our Site and User/Buyer information and prevent unauthorized access to it or use thereof through generally accepted industry standard technologies and internal procedures. Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use of your Personal Information will never occur. SANKARA CUISINE LTD SHALL NOT BE RESPONSIBLE OR LIABLE FOR UNAUTHORIZED ACCESS, HACKING, OR OTHER SECURITY INTRUSIONS OR FAILURE TO STORE OR THE THEFT, DELETION, CORRUPTION, DESTRUCTION, DAMAGE, OR LOSS OF ANY DATA OR INFORMATION.
Direct Marketing
You hereby agree that we may use your contact details you provided us with (including, without limitation, e-mail address and phone number) for the purpose of providing you commercial and/or non-commercial materials and informing you regarding current and/or new Products, products and services (offered by the Company and/or by third parties) which may interest you and to send to you advertisements and other marketing material, transmitted to the e-mail address and/or phone number you have provided. You may withdraw your consent via sending a written notice to the Company by email to the following address: customerservice@sankaracuisine.com or alternatively follow the instructions for removing yourself from the mailing list which are available in the message transmitted to you.
Third Party Service Providers
While using the Sankara Cuisine Site, you, The User/The Buyer, must understand that we, The Company, may use third party software and/or services, in order to collect, host, store and/or process the information detailed herein and mainly for statistical purposes. The Sankara Cuisine Site uses commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing and use of non-personal and personal information. Such software and service include without limitation: Google Analytics which privacy policy can be found at http://www.google.com/policies/privacy/partners/
However, The User/The Buyer must understand and acknowledge that Sankara Cuisine does not control such third party service providers. Please read their terms of use and privacy policies to understand their privacy practices in more detail. The User undertakes the responsibility of informing themselves on the practices and methodologies which govern the Third Party services and softwares.
Minors
The Site is intended for Users over the age of eighteen (18). Therefore, Sankara Cuisine Ltd. does not intend to collect Personal Information from children under the age of eighteen. Sankara Cuisine reserves the right to request proof of age at any stage so that we can verify that minors under this age are not using the Site in any way shape or form.
Changes to the Privacy Policy
The terms of this Privacy Policy will govern the use of the Site and Services and any information collected with respect thereto. The Company reserves the right to change this policy at any time, so please note that it is the responsibility of The User to re-visit this page frequently to stay informed. In case of any material change, we will make reasonable and timely efforts to post a clear notice on The Site regarding changes. We will provide notice of substantial changes of this policy on the homepage of the Site and we will send you an email regarding such changes to the e-mail address that you have provided us with. Such substantial changes will take effect seven (7) days after such notice was provided on the Site or sent by e-mail, whichever is the earlier. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Site after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes. Changes to the Terms
Sankara Cuisine reserves all rights to amend the Terms and Conditions of this End-User Agreement at any time by posting revised items in the newest revision of the Terms and Conditions on the Ordering Platform. These amended Terms and Conditions shall be binding upon You the Customer/The User. We will also notify The Users directly through communication on the Ordering Platform that changes will occur and will make necessary amendments seven (7) days after making proposed amendments.
We are a licensed, insured company cooking out of a licensed commercial kitchens located in each city or region in which we offer our services. All of our products are hand-made and hand-packaged by our team of Chefs and food businesses.
*** PLEASE NOTE: Our products are made in a facility that processes foods that contain wheat (gluten), milk, eggs, soy, peanuts, tree nuts, seeds, meat, fish, poultry, pork, and chocolate. While some products may not contain all of these products, small amounts of them may be found in our products. This is outside of our control.
